DUI Defense Attorneys Question Breathalyzer Accuracy

Breathalyzers have a longer history than we may have thought. There has been research dating as far back as 1874 looking into the possibility to use a person’s breath to test for alcohol. The first machine used by police to test drivers for driving under the influence was called the drunkometer developed in 1938. A sample of the drivers breath was mixed with an acidified potassium permanganate solution and if there was any alcohol on the driver’s breath, it would change color. Over the years, scientists improved upon the machine to make it able to actually measure blood alcohol content (BAC). These inventions provided law enforcement with a way to test and get immediate results on the scene.

No breathalyzer directly measures the blood alcohol content as that can only be done through a blood sample. The BAC is measured indirectly through the amount of alcohol on a person’s breath. They use spectrophotometer technology, electrochemical fuel cell technology, or a combination. In addition to the breathalyzer, law enforcement may also conduct field sobriety tests.

In Utah, and many other states, if your breathalyzer reading is greater than 0.08, it is asssumed that your driving is impaired due to alcohol. Being arrested of a DUI can result in jail time, community service, license suspenditure, and fees up to $12,500.

In fact, the type of breathalyzers used by Utah law enforcement have actually been rejected in other states due to their inaccurate readings. It has been estimated that 23% of people will have a result that is higher than their true blood alcohol content. Another factor that contributes to inaccuracy is there are other food compounds that are similar to ethanol that could increase or cause inaccurate results.

The Key To Successful Tooth Implants
